Customer Ownership and Control

As between Detect UAS and the customer, the customer retains its rights in customer-provided materials unless otherwise established in a written agreement.

Detect UAS does not acquire ownership of a customer’s confidential operational information, footage, photographs, documents, or other materials merely because those materials are provided to us in connection with a project.

Detect UAS does not use confidential customer operational content for third-party behavioral advertising.

No General-Purpose AI Training

4. LOCATION AND TELEMETRY INFORMATION

Detect UAS does not require a visitor's precise physical location merely to visit the public Detect UAS website.

Transactional, customer-service, security, contractual, or other communications necessary to maintain a business relationship may continue even if an individual opts out of promotional messages.

8. WHEN DETECT UAS ACTS ON BEHALF OF A CUSTOMER

In some engagements, Detect UAS may process information at the direction of a customer organization.

For example, a customer may determine:

  • what information is provided to Detect UAS

In these circumstances, Detect UAS may act as a service provider or processor to the customer.

Individuals seeking to exercise rights concerning information controlled by a customer organization may need to contact that organization directly.

If Detect UAS receives a request concerning information controlled by a customer, we may refer the request to that customer or assist the customer in responding as appropriate.

Nothing in this Privacy Policy changes a governmental customer's obligations under applicable public-records, freedom-of-information, records-retention, evidentiary, privacy, criminal-procedure, aviation, surveillance, or other laws.

9. HOW WE DISCLOSE INFORMATION

Detect UAS may disclose information when reasonably necessary for legitimate business, operational, security, contractual, or legal purposes.

These providers may process information on our behalf in connection with the services they provide.

Customer-Directed Disclosure

Detect UAS may disclose information as directed or authorized by a customer in connection with a project, training engagement, consultation, demonstration, event, or other service.

Professional Advisers

We may disclose information to attorneys, accountants, insurers, consultants, or other professional advisers when reasonably necessary for legitimate business or legal purposes.

Legal Requirements

We may disclose information when we reasonably believe disclosure is necessary to:

  • comply with applicable law

  • protect the rights, property, systems, or safety of Detect UAS or others

  • investigate fraud, abuse, or security incidents

  • establish, exercise, or defend legal claims

Where legally permitted and reasonably practicable, Detect UAS may notify an affected customer before disclosing customer-controlled information in response to compulsory legal process.

Business Transactions

If Detect UAS LLC is involved in a merger, acquisition, financing, restructuring, sale of assets, or similar transaction, information may be disclosed to appropriate parties as part of that transaction, subject to reasonable confidentiality protections.

10. WE DO NOT SELL PERSONAL INFORMATION

Detect UAS does not sell personal information to data brokers or other third parties in exchange for money.

Detect UAS does not share personal information for cross-context behavioral advertising.

Detect UAS does not use confidential customer operational content for targeted advertising.

Where applicable privacy law defines “sale,” “sharing,” or targeted advertising differently, Detect UAS will honor legally applicable rights concerning such processing.

11. GLOBAL PRIVACY CONTROL AND OPT-OUT SIGNALS

Certain privacy laws recognize browser-based universal opt-out mechanisms, including Global Privacy Control.

Detect UAS does not currently sell personal information or use personal information for cross-context behavioral advertising.

Accordingly, an opt-out signal generally should not materially change these practices because Detect UAS does not engage in those activities in the first instance.

If Detect UAS practices change in a manner that makes recognition of such a signal legally required, Detect UAS will honor applicable opt-out preference signals as required by law.

12. INFORMATION RETENTION

Detect UAS retains different categories of information for different periods depending upon why the information was collected or processed.

Factors affecting retention may include:

Customer, billing, contractual, proposal, and business records may be retained for a reasonable period after a customer relationship or project ends.

Project files and customer-provided materials may be retained for a period reasonably necessary to complete the applicable engagement, provide support, maintain business records, or satisfy contractual or legal requirements.

When information is no longer reasonably required, Detect UAS may delete, anonymize, aggregate, or securely dispose of it, subject to legal, contractual, technical, backup, insurance, and recordkeeping limitations.

13. DATA SECURITY

Detect UAS uses administrative, technical, and organizational safeguards designed to protect information against unauthorized access, use, alteration, loss, or disclosure.

No Internet-connected system, cloud platform, communications service, wireless network, or security technology can guarantee absolute security.

Customers should notify Detect UAS promptly if they believe information provided to Detect UAS or an account or service associated with Detect UAS has been compromised.

14. DATA BREACHES AND SECURITY INCIDENTS

If Detect UAS becomes aware of a security incident involving personal information, we will investigate and respond as appropriate to the circumstances.

Where notification to an affected customer, individual, regulator, law-enforcement authority, or other party is required by applicable law or contract, Detect UAS will provide such notification in accordance with those requirements.

Detect UAS may also take measures reasonably necessary to contain, investigate, remediate, or reduce the effects of a security incident.

15. PRIVACY RIGHTS

Depending upon where an individual resides, the nature of the information, and the circumstances in which Detect UAS processes the information, applicable privacy laws may provide certain rights concerning personal information.

These rights may include the right to:

  • confirm whether personal information is being processed

  • obtain a copy of certain personal information

  • correct inaccurate personal information

  • request deletion of personal information

  • obtain certain information in a portable format

  • opt out of certain sales of personal information

  • opt out of certain targeted advertising

  • opt out of certain profiling

  • restrict or limit certain processing of sensitive personal information

  • withdraw consent where processing is based upon consent

  • appeal certain decisions regarding a privacy request

These rights are subject to applicable exceptions and do not apply in every circumstance.

Detect UAS may need to retain information to comply with law, fulfill contractual obligations, maintain security, complete transactions, maintain appropriate business records, establish or defend legal claims, or for other legally permitted purposes.

16. HOW TO MAKE A PRIVACY REQUEST

Privacy requests may be submitted to:

joe@detectuas.com

or by mail to:

Detect UAS LLC
222 Main St.
STE 260
Farmington, CT 06032

Please identify the request as a Privacy Request and provide sufficient information for us to understand the request.

Detect UAS may need to verify the identity and authority of the person making a request before providing, modifying, or deleting personal information.

We will not discriminate against an individual for exercising a privacy right provided by applicable law.

Where applicable law provides a right to appeal our response to a privacy request, an appeal may be submitted to joe@detectuas.com with the subject line Privacy Request Appeal.

If the information is controlled by one of our customer organizations rather than Detect UAS, we may direct the requester to that customer.

17. CONNECTICUT PRIVACY RIGHTS

Detect UAS is based in Connecticut.

Connecticut law provides certain residents with rights concerning personal data when applicable privacy laws apply to the particular business and processing activity.

Depending upon the circumstances, applicable rights may include access, correction, deletion, data portability, and the ability to opt out of certain sales, targeted advertising, or profiling.

Detect UAS will process applicable Connecticut privacy requests in accordance with the requirements and exceptions of Connecticut law.

Some information processed by Detect UAS may be outside the scope of particular consumer privacy laws because of the nature of the individual, organization, information, customer relationship, processing activity, or applicable statutory exemption.

Nothing in this Privacy Policy should be interpreted as a representation that a particular privacy statute applies to information or processing activities that are legally exempt from that statute.

18. GOVERNMENT AND PUBLIC-SAFETY INFORMATION

Detect UAS customers, partners, or training participants may include law-enforcement agencies, fire departments, emergency-management organizations, municipalities, governmental entities, contractors, and other organizations performing public-safety functions.

Information used or provided by those organizations may be governed by laws, policies, contractual requirements, and records obligations that differ from ordinary consumer information.

The relevant governmental or public-safety organization is responsible for determining its legal authority to collect, operate, record, transmit, retain, distribute, disclose, and otherwise use its information.

Detect UAS providing consulting, training, technical support, equipment-related assistance, or other services does not transfer responsibility for an agency's compliance with constitutional requirements, public-records laws, evidence rules, surveillance laws, aviation requirements, retention requirements, agency policies, warrants, court orders, or other legal obligations.

Requests concerning an agency's public records, operational records, footage, or other agency-controlled information should ordinarily be directed to that agency rather than Detect UAS.

19. AVIATION, REGULATORY, AND SPECIALIZED INFORMATION

Detect UAS operates in an industry in which customers may be subject to specialized aviation, public-safety, security, privacy, evidentiary, or regulatory requirements.

Use of Detect UAS consulting, training, technical services, recommendations, or other services does not by itself establish that a customer's operation complies with:

  • Federal Aviation Administration requirements

  • state or local drone laws

  • agency policies

  • Criminal Justice Information Services requirements

  • evidentiary requirements

  • public-records requirements

  • privacy or surveillance laws

  • cybersecurity frameworks

  • other regulatory or certification requirements

Customers with specific mandatory compliance requirements should identify those requirements before providing regulated, sensitive, or restricted information to Detect UAS.

Where Detect UAS enters into a specific written agreement addressing a compliance framework or regulated category of information, that agreement may supplement this Privacy Policy.

20. CHILDREN'S PRIVACY

Detect UAS is primarily designed for governmental, public-safety, professional, commercial, and organizational customers.

The Detect UAS website and services are not directed toward children for their personal or consumer use.

We do not knowingly solicit children to provide personal information for ordinary consumer purposes.

Because drone footage, photography, video, training materials, or customer-provided project materials may depict real-world environments, individuals under the age of 18 may incidentally appear in imagery or information supplied by a customer.

Detect UAS does not control every scene captured by a customer's drone, camera, or other imaging system.

The customer or operator responsible for collecting the information is responsible for determining whether and under what circumstances the information may lawfully be collected, used, retained, transmitted, or disclosed.

21. EMAIL AND COMMUNICATIONS

Detect UAS may send customers and business contacts communications relating to:

  • inquiries

  • proposals

  • consultations

  • projects

  • scheduling

  • training

  • demonstrations

  • events

  • billing

  • support

  • service updates

  • product or service changes

  • other operational or business matters

Certain communications may be necessary to provide requested services or maintain a customer relationship and may not include an opt-out mechanism.

We may separately send marketing or promotional communications where permitted by law.

Recipients may opt out of promotional emails using the unsubscribe mechanism provided in the communication or by contacting us.

Opting out of promotional communications will not prevent us from sending transactional, contractual, billing, scheduling, customer-service, or security communications.

22. THIRD-PARTY LINKS AND SERVICES

The Detect UAS website or services may contain links to or integrate with websites, applications, drone manufacturers, software platforms, training resources, mapping services, equipment providers, government websites, social-media platforms, or other third parties.

Detect UAS is not responsible for the privacy practices of independent third parties.

Information provided directly to another organization is governed by that organization's privacy practices and terms.

Customers should review the privacy policies and terms of third parties they choose to use in connection with Detect UAS services or their own UAS operations.

23. INTERNATIONAL USERS

Detect UAS is operated by a United States company and is primarily intended for customers in the United States.

If an individual accesses the Detect UAS website or services from another country, information may be transferred to and processed in the United States.

Privacy and data-protection laws in the United States may differ from those in the individual's country.

Customers with specific requirements concerning international data transfers or data residency should contact Detect UAS before providing information subject to those requirements.

24. DE-IDENTIFIED AND AGGREGATED INFORMATION

Detect UAS may create or use information that has been aggregated or de-identified so that it does not reasonably identify an individual or reveal a customer's confidential operational information.

Such information may be used to:

  • understand general business or service usage

  • evaluate website performance

  • improve services

  • develop training

  • improve internal processes

  • troubleshoot technical issues

  • understand general industry needs

  • plan future products or services

Detect UAS will not attempt to re-identify information that is maintained as de-identified where prohibited by applicable law.

This provision does not authorize Detect UAS to publicly disclose identifiable or confidential customer operational information.

25. SOCIAL MEDIA AND PUBLIC CONTENT

Detect UAS may maintain profiles or pages on social-media platforms and other third-party websites.

When an individual interacts with Detect UAS through a social-media platform, the platform may collect and process information in accordance with its own privacy policies.

Information an individual chooses to post publicly, including comments, reviews, photographs, videos, tags, or other content, may be visible to other users of the applicable platform.

Detect UAS may share, repost, or respond to publicly available content relating to Detect UAS where appropriate.

Confidential customer operational materials will not be treated as public merely because Detect UAS maintains social-media accounts.

26. CHANGES TO THIS PRIVACY POLICY

Detect UAS may update this Privacy Policy to reflect changes in our services, technology, business practices, security measures, or legal obligations.

When this Privacy Policy is updated, the Last Updated date at the beginning of the policy will be changed.

If a change materially affects how we process personal information, we may provide additional notice where appropriate or required by law.

The current Privacy Policy will be made available through detectuas.com.
